These Terms of Service (hereinafter — "Terms") govern the use of mobile applications Weather Scope and Floralia (hereinafter — "Applications"), developed by Vladislav Sidelnikov (hereinafter — "Developer", "we", "us").

1. Acceptance of Terms

By downloading, installing, or using any of our Applications, you confirm that:

• You have read and understood these Terms
• You are 18 years of age or older (or 13 years with parental/guardian consent)
• You have the legal capacity to enter into a legally binding agreement
• You will comply with all applicable laws and regulations

2. License to Use

2.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Applications on your personal devices running iOS, iPadOS, tvOS, macOS, or visionOS solely for personal, non-commercial use.

2.2 License Restrictions

You may not:

• Copy, modify, or create derivative works based on the Applications
• Distribute, transfer, sell, rent, or sublicense the Applications
• Reverse engineer, decompile, or disassemble the Applications
• Remove or alter copyright notices
• Use the Applications unlawfully or in violation of these Terms
• Use the Applications for commercial purposes without written permission

3. Application Usage

3.1 Weather Scope

• The application is available for iOS, iPadOS, tvOS, macOS, and visionOS
• Location access is required to obtain weather forecasts. On tvOS and macOS, IP geolocation with default coordinates is used when precise location is unavailable
• The application uses a proprietary Watch Weather API for weather data, deployed on the zerikc.ru server
• You can add an unlimited number of cities to favorites for quick switching between locations. The favorites list is stored locally on your device
• Weather data and favorite locations are stored locally on your device using Core Data for fast access
• Weather forecasts are provided "as is" and are for informational purposes only
• The Developer is not responsible for the accuracy of weather forecasts provided by the Watch Weather API
• Do not use the application for making critical safety-related decisions (aviation, maritime transport, emergencies)
• The application does not require registration or account creation
• All data is stored locally on your device and is not transmitted to third-party servers

3.2 Floralia

• The application is intended for informational purposes only
• It is not a medical device and does not replace professional medical consultation
• Forecasts and recommendations are approximate
• For health issues, consult a doctor
• The application works locally and does not require registration or account creation
• When using iCloud sync, an active iCloud+ subscription with sufficient storage is required
• The Developer does not have access to your data in iCloud
• The application supports an optional pregnancy planning feature with conception probability calculation
• For data protection, an optional app lock is available using PIN code and biometric authentication (Face ID/Touch ID)

4. User Accounts

4.1 Registration

Floralia: Does not require registration or account creation. When using iCloud sync, your existing Apple ID is used.

Weather Scope: Does not require registration or account creation. All data is stored locally on your device.

4.2 Termination of Use

We reserve the right to suspend or delete your account (if applicable) in case of violation of these Terms.

5. User Content

5.1 Your Content

You retain all rights to content that you create, upload, or save in the Applications (diary entries, checklists, settings). We do not claim ownership of your content.

5.2 Content License

Floralia: Your data is stored in your personal iCloud storage. The Developer does not have access to your content and does not receive any licenses to it.

Weather Scope: All weather data is stored locally on your device. The Developer does not have access to your content and does not receive any licenses to it.

5.3 Prohibited Content

You may not create or store content that:

• Violates laws or third-party rights
• Contains viruses or malicious code
• Is illegal, offensive, or unacceptable

6. Intellectual Property

All rights to the Applications, including source code, design, graphics, text, and trademarks, belong to the Developer and are protected by copyright and intellectual property laws.

7. Privacy

The collection and use of your personal data is governed by our Privacy Policy, which is an integral part of these Terms.

8. Payments and Subscriptions

8.1 Free Use

Currently, all Applications are provided free of charge. We reserve the right to introduce paid features or subscriptions in the future with prior notice.

8.2 App Store Purchases

In case of introducing paid features, all transactions will be processed through the Apple App Store in accordance with Apple's terms.

9. Disclaimer of Warranties

The Applications are provided "as is" and "as available" without any warranties, express or implied, including but not limited to:

• Merchantability warranties
• Fitness for a particular purpose
• Non-infringement
• Security or absence of errors

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer is not liable for any direct, indirect, incidental, special, or consequential damages arising from:

• Use or inability to use the Applications
• Loss of data or information
• Unauthorized access to your data
• Errors, failures, or inaccuracies in the Applications
• Actions of third parties (Apple)

11. Indemnification

You agree to defend, indemnify, and hold harmless the Developer from any claims, damages, liabilities, and expenses arising from your violation of these Terms or improper use of the Applications.

12. Changes to Applications

We reserve the right at any time to:

• Modify, suspend, or discontinue any part of the Applications
• Update functionality and fix errors
• Modify or discontinue cloud service support

We will try to notify you of significant changes, but are not obligated to do so.

13. Changes to Terms

We may periodically update these Terms. Material changes take effect 30 days after publication of the updated version. Continued use of the Applications after changes take effect means you agree to the updated Terms.

14. Termination

These Terms remain in effect until terminated by you or us. You may terminate at any time by deleting the Applications and your account. We may terminate immediately in case of your violation of the Terms.

15. Applicable Law and Dispute Resolution

15.1 Applicable Law

These Terms are governed by and construed in accordance with the laws of the Russian Federation.

15.2 Dispute Resolution

In case of disputes related to the use of the Applications, the parties undertake to try to resolve them through negotiations. If agreement is not reached, disputes are subject to resolution in court at the Developer's location.

16. Apple Agreements

These Applications are distributed through the Apple App Store and are subject to Apple's Standard License Agreement . In case of conflict between these Terms and Apple's terms, Apple's terms take precedence.

16.1 Apple's Role

• Apple is not a party to these Terms
• Apple is not responsible for the Applications and their content
• Apple is not obligated to provide support for the Applications
• All quality claims should be directed to the Developer, not Apple

17. Export Control

The Applications are subject to export laws and regulations. You agree to comply with all applicable export and re-export restrictions.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to be in full force and effect.

19. Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement between you and the Developer regarding the use of the Applications and replace all previous arrangements.

By using our Applications, you confirm that you have read, understood, and agree to comply with these Terms of Service.
